Will

Why do I need I will?

If you have a complex family situation, such as a second marriage or step children, or if you are sharing your home with someone who is your civil partner? If your permanent home is outside of the UK or you have an investment property abroad and you want to leave money or property to dependants who cannot care for themselves? If you have small kids and a mortgage, it is time to put a Will in place to ensure that your wishes are being followed in any emergency and avoid potential family disputes after you pass away.

A will is the only way to make sure your money, property, possessions and investments go to the people which you care about e.g. your spouse, children, grandchildren, parents or your friends. If you die without a legally valid will in place it is known as dying “intestate”, meaning that the law decides how your estate is divided up which follows a strict line of succession.

No Will? No LPA? Need Trustee services?

Here are some important things to think about which you need to include in your will:

  • Beneficiaries are the ones you want to receive your assets, such as savings, current accounts, investment portfolios and property when you die, including charities.
  • Plan B, what happens should any beneficiaries die before you.
  • Dependents can be your children, your parents, grandchildren. What will be the care plans if your children for example are under 18, your relatives with disabilities and your pets.
  • Executors or Trustees are the people who you want to carry out your wishes as set out in the will.
  • Extras – for instance, are such things as your digital assets (cryptocurrencies, bitcoins, social media accounts such as Facebook, Instagram or Tick-tock account) and what you want to happen to them.

There are a few other things of financial planning to consider while you are writing a will such as tax on legacies, testamentary trust and LPA which is usually set up alongside the Will.
