Key stages and typical timescales
Initial consultation and advice
We review your contract, the dismissal and the evidence, explain the merits and the time limits, and set out the options. Time limits for tribunal claims are strict, so please contact us promptly.
ACAS early conciliation
Before a claim can be issued, ACAS early conciliation is required. It lasts up to 6 weeks and often leads to settlement discussions.
Claim or response
We prepare the claim form (ET1) or the employer’s response (ET3) and the supporting documents.
Preparation for the hearing
We deal with the tribunal’s directions: a preliminary hearing if one is listed, exchange of documents, the hearing bundle, witness statements and a schedule of loss. Settlement can be negotiated at any stage.
Final hearing
We prepare for and represent you at the final hearing, or instruct a barrister where that is agreed with you.
Overall timescale. Many claims settle before a hearing. Where a claim goes to a final hearing, it can often take 12 months or more from issue, depending on the tribunal’s listing times.
Who will handle your matter
Employment matters are handled by Niccolo Serafino, Solicitor & Partner, and supervised by Taras Demchuk, Managing Partner.
Not included in these fees
- Barristers’ fees and expert evidence, unless agreed
- Appeals to the Employment Appeal Tribunal and enforcement of an award
- Separate advice on a settlement agreement offered outside the claim
